EXPRESS CONSULTATION

During an Express Consultation we listen to your story, and take detailed instructions. After checking that we have a thorough understanding of your family law needs, and the questions that you want answered, we step you through different options and advise you on the best ways to achieve your goals. Sometimes, we have to give tough advice.  This can be hard to hear, but we never shy away from our responsibility, as trusted advisors, to give a realistic assessment of your case. After the consultation, we will send you a thorough letter of advice and an estimate of costs.

LAWYER-ASSISTED MEDIATION

Over many years, our team has gained the experience and expertise necessary to consistently negotiate great outcomes for our clients at lawyer-assisted mediations. We start by meeting with you to establish your goals and align expectations. We oversee the disclosure process to ensure, you have all the information you need to make good decisions. At your lawyer-assisted mediation, we are on hand to advise you about the advantages and disadvantages to you, of different options. We support you to speak up for yourself and we make sure that you are not bullied into accepting a settlement that does not deliver your full rights and entitlements. If you get stuck on a particular issue, we help you to think outside the square and to creatively explore solutions that work for you and your family.  Once we have negotiated an agreement that you are happy with, we draft it up for both parties to review and sign. This ensures that when you walk out the door at the end, you have a tailor-made road-map to get you where you want to be.

PRIVATE ARBITRATION

An Arbitration is a quicker, more streamlined process than applying to the Court for Property Orders. going to Court for parties who cannot resolve a property dispute. It is a voluntary process in which the parties jointly appoint an Arbitrator to determine how the property of their relationship will be divided. The parties each present evidence and make submissions to the Abritrator in support of their case.  informal decision is handed down in an Award which can be binding or non-binding on the parties and which can be registered in the Family Court as Final Orders - Property.   in  is a process (other than the judicial process) in which parties to a financial dispute present arguments and evidence to an independent arbitrator, who makes a determination to resolve the dispute (see section 10L of the Family Law Act 1975).

Parties agree on who is to be appointed as the arbitrator (usually a senior member of the legal profession) and, with the consent of all parties, the Court may make an order referring Part VIII proceedings or Part VIIIAB proceedings (other than proceedings relating to a Part VIIIAB financial agreement) to arbitration.

Parties may also undertake private arbitration (which is arbitration that has not been ordered by the Court)

An In-Depth Analysis starts with a pre-planning meeting and depending on your needs, the process may include joint conferences with your accountant, mortgage broker or financial planner to ensure that your chosen strategy is tax-efficient and financially prudent.
