PRIVATE ARBITRATION
A Private Property Arbitration is a quick, streamlined and confidential, way of obtaining a ruling about the division of the assets of a relationship. An Arbitration is a great option in circumstances where it could take up to three years to get trial dates for a property dispute in the Court system or where the separating parties have joint commercial interests that they need to protect. It can be Court-Ordered or voluntary, with both parties jointly appointing and paying for an Arbitrator to determine how the property of their relationship will be divided. Whilst an Arbitration is more informal, each party still presents their evidence, cross-examines the other side and makes submissions in support of their proposed Property Orders. At the end of the Arbitration process, a decision is handed down in the form of an 'Award' which can be binding or non-binding and which can be registered in the Family Court as Final Orders - Property.
